Acceptance of terms

By accessing or using rivieraonthebay.com ("the Site"), you agree to be bound by these Terms of Use. If you do not agree, please do not use this Site. These terms apply to your use of the Site only — separate rental agreement terms apply to actual bookings.

About this site

Riviera on the Bay is a privately owned vacation rental property at Bayside Walk, Mission Beach, San Diego, California 92109. This Site provides information about the property and facilitates contact with the host. It is not a booking engine and does not process payments.

All reservations made through this Site are finalized via direct email agreement with the host. Reservations made through Airbnb (airbnb.com/rooms/15833584) are governed by Airbnb's Terms of Service.

Intellectual property

All content on this Site — including photographs, text, design, and graphics — is owned by or licensed to Riviera on the Bay. You may not copy, reproduce, distribute, or use any content from this Site without written permission.

Photography may not be used for commercial purposes, repurposed for other rental listings, or redistributed without explicit consent.

Accuracy of information

We make reasonable efforts to ensure the accuracy of property descriptions, amenity lists, and pricing information displayed on this Site. However, details may change between updates. All final booking terms — including pricing, availability, house rules, and included amenities — are confirmed in direct communication with the host before a reservation is finalized.

House rules — rental guests

All guests staying at Riviera on the Bay agree to the following rules as a condition of their stay. Violation may result in immediate termination of the rental with no refund:

Maximum occupancy: 10 guests at all times. Unregistered guests are not permitted.
Check-in: 4:00 PM or later. Early check-in is not guaranteed.
Check-out: 10:00 AM or earlier. Late check-out must be pre-approved.
No smoking anywhere on the property, including all outdoor areas.
No pets of any kind.
No parties or events. The property is for registered guests only.
Quiet hours: 10:00 PM – 8:00 AM. Respect neighbors.
Hot tub safety: The hot tub has no gate or lock. Children must be supervised at all times near the hot tub and bay access areas.
Water safety: Mission Bay is an open body of water. Guests assume responsibility for their own water activities and the supervision of children near water.
Security cameras: Exterior security cameras are present on the property. No interior cameras exist.
Property damage: Guests are responsible for any damage beyond normal wear and tear. A refundable security deposit applies to all bookings.
Trash: All trash must be bagged and placed in the designated bins before check-out.

Cancellation and refund policy

Cancellation terms vary by season and booking method. The applicable cancellation policy will be stated clearly in your booking confirmation. As a general guide:

Cancellations made 60+ days before check-in: full refund less a processing fee
Cancellations made 30–59 days before check-in: 50% refund
Cancellations made less than 30 days before check-in: no refund unless the dates are rebooked

Bookings made through Airbnb are subject to Airbnb's cancellation policy as displayed at time of booking.

⚠ The host reserves the right to cancel any reservation that appears to be made in bad faith, involves misrepresentation of guest count, or is intended to circumvent house rules. In such cases, a full refund will be issued.

Limitation of liability

To the fullest extent permitted by California law, Riviera on the Bay and its owner(s) shall not be liable for:

Personal injury or property damage occurring during a guest's stay, except where caused by the host's gross negligence
Loss or theft of personal belongings
Disruptions caused by weather, neighboring properties, city events, or other circumstances outside the host's control
Service outages affecting internet, utilities, or appliances that are promptly reported and addressed
Any indirect, incidental, or consequential damages arising from use of this Site

Guests are encouraged to obtain travel insurance to protect against unforeseen cancellations or emergencies.

Governing law

These Terms of Use and any rental agreements are governed by the laws of the State of California. Any disputes shall be resolved in the courts of San Diego County, California.

Changes to these terms

We reserve the right to update these Terms at any time. The "Last updated" date reflects the most recent revision. Continued use of the Site constitutes acceptance of any changes.
